Torts — Negligence

The Double-Parked Van

A delivery driver, Morgan, double-parked with the engine running and hazards off on a foggy morning. A cyclist, Reese, swerved to avoid the car, fell, and was then struck by a second car, driven by Drew, following too closely. Reese sues Morgan.

Law. Negligence requires duty, breach, causation (both actual "but-for" cause and proximate cause limited to foreseeable harms), and damages. An intervening act breaks the chain only if it was unforeseeable.

In two or three short paragraphs, advise whether Morgan is liable, addressing both breach and causation (including the second car).
