Torts — False Imprisonment
The Locked Stockroom
A store manager, Alex, suspected Reese of shoplifting, told Reese to wait in the stockroom, and stood blocking the only unlocked exit while saying security was on the way. Reese, intimidated, stayed for twenty minutes and never tried the door. There was in fact an unlocked rear fire exit behind some shelving that Reese did not know about.
Law. False imprisonment is (1) an intentional act by the defendant that (2) confines the plaintiff to a bounded area, (3) against the plaintiff's will, where (4) the plaintiff is aware of the confinement at the time or is harmed by it. Confinement may be by physical barrier, force, threats of force, or asserted legal authority. An area is not bounded if there is a reasonable means of escape the plaintiff is aware of; a means of escape the plaintiff does not know about does not defeat confinement.
In one paragraph, advise whether Alex falsely imprisoned Reese.
